1. About us
Be Or8 is a service provided by Perma Digital, Congleton Business Centre, Grosvenor House, 3 Chapel Street, Congleton, Cheshire, CW12 4AB. You can contact us at [email protected].
In these terms, "we", "us" and "our" mean Perma Digital. "You" means the person using the service. "Images" means the files you upload, and "Outputs" means the processed files we return to you.
2. The service
Be Or8 removes watermarks from images you upload. Each image goes through our automated process and then a manual quality check before we release the Output to your account.
We accept PNG, JPG, JPEG and WEBP files up to 15MB each. We aim for a clean result, but results depend on the source image. We can't guarantee that every watermark can be fully removed, or that every Output will be identical to an unwatermarked original.
3. Your account
You need an account to place an order. You must give us accurate details, keep your login secure, and tell us straight away if you think someone else has accessed your account. You're responsible for activity on your account. You must be at least 18, or have a parent or guardian's permission, to use the service.
4. Your images and rights
By uploading an Image, you confirm that:
- you own the copyright in the Image, or you have the copyright holder's permission to remove its watermark and use the result; and
- removing the watermark and using the Output won't infringe anyone else's rights or break any law.
You keep all rights you have in your Images and Outputs. You give us a limited licence to store, copy and process your Images only so we can provide the service to you.
If someone makes a claim against us because you broke this section, you agree to cover the reasonable losses and costs we incur as a result.
5. Prohibited use
You must not use Be Or8 to:
- remove watermarks from stock photos, previews or other people's work that you haven't licensed;
- upload unlawful, abusive or sexually explicit material, or any image of a child that's indecent or exploitative;
- upload files containing malware, or try to disrupt, overload or reverse-engineer the service.
We may refuse, pause or cancel an order we reasonably believe breaks these rules. If we cancel an order for any other reason, we'll refund it in full. We may also report unlawful material to the appropriate authorities.
6. Prices and payment
The price is £0.99 per image. We're not VAT registered, so no VAT is added and the price you see is the total you pay. You'll see the total before you pay. Payment is taken by Stripe when you place your order, and we never see or store your card details. We may change our prices, but a change won't affect an order you've already paid for.
7. Processing and delivery
We start processing once payment is confirmed. Because every Output is checked by a person, we don't promise a fixed turnaround time, but we'll always complete your order within a reasonable time. Outputs are delivered to your Client Area for download, and we'll email you when they're ready.
8. Your right to cancel
As a consumer, you normally have 14 days to cancel a service contract. At checkout, you ask us to start processing straight away. You can cancel any order we haven't finished processing for a refund of the images not yet completed. Email [email protected] with your order number. Once an image has been processed and its Output released, you lose the right to cancel for that image, as set out in the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
9. Quality and refunds
If an Output isn't of satisfactory quality or doesn't match what we've described, email us within 14 days of it being released. We'll re-process the image or refund it. If our quality check finds we can't produce an acceptable result for your order, we'll reject it and refund you in full automatically. Our refund policy has the details. Nothing in these terms affects your statutory rights under the Consumer Rights Act 2015.
10. Your files and data
We store your Images and Outputs so you can download them again from your Client Area. You can ask us to delete them at any time by emailing [email protected]. Our privacy policy explains how we handle your personal data.
11. Our liability
We're responsible for loss or damage you suffer that's a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We're not responsible for loss or damage that isn't foreseeable.
If you use the service for business purposes, we're not liable for loss of profit, business or opportunity. Our total liability for any order is limited to the amount you paid for it.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't legally be limited.
12. Suspension and closing your account
You can close your account at any time by contacting us. We may suspend or close your account if you seriously or repeatedly break these terms. Closing your account doesn't affect orders that have already been completed and paid for.
13. Changes to these terms
We may update these terms from time to time. The version in force when you place an order applies to that order. We'll tell you about significant changes before they affect you.
14. Complaints and governing law
If you have a complaint, email [email protected] and we'll get back to you as soon as we can. These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
